Acceptance of Terms

Welcome to Caratory. These Terms of Service ("Terms") govern your access to and use of caratory.com and its services (the "Service"), operated by Caratory ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

The Service

Caratory is an AI-powered tool that transforms a flat jewelry product photo into on-model, white-background, and detail images for e-commerce use. Results are generated by artificial intelligence and may vary; while we work to keep your product accurate, generated images may contain imperfections, and you are responsible for reviewing them before use.

Accounts

To use the Service you must create an account and provide accurate information.
You are responsible for keeping your login credentials secure and for all activity under your account.
You must be at least 16 years old to use the Service.
Notify us promptly of any unauthorized use of your account.

Credits and Payments

The Service runs on a credit system. New accounts receive a number of free credits; additional credits may be purchased.
Each generation consumes credits as shown in the app. Credits for failed generations are not charged.
Paid credits are generally non-refundable except where required by law. Prices may change with notice.
Payments are processed by a third-party payment provider; by purchasing you also agree to that provider's terms.

Your Content and the Images You Generate

Your uploads: You retain all rights to the product photos you upload. You represent that you own or have permission to use them and that they do not infringe anyone's rights.
Your outputs: Subject to your compliance with these Terms and payment of applicable credits, you own the images you generate and may use them for commercial purposes, including your product listings and marketing.
You are solely responsible for how you use generated images, including ensuring they accurately represent the products you sell.

Acceptable Use

You agree not to use the Service to:

Generate, request, upload, or attempt to produce adult, pornographic, sexually explicit, NSFW, nude, or sexually suggestive content of any kind.
Generate, request, or upload any content that sexualizes, exploits, or endangers minors.
Generate hateful, harassing, violent, gory, or otherwise offensive content.
Upload content you do not have the right to use, or that infringes intellectual property or privacy rights.
Create misleading, deceptive, illegal, or harmful content, or content that impersonates real individuals without consent.
Attempt to reverse-engineer, resell, scrape, or disrupt the Service, or bypass its security or usage limits.
Violate any applicable law or regulation.

We may suspend or terminate accounts that violate these Terms.

Prohibited Content

Caratory is a professional jewelry photography tool intended solely for lawful, commercial product imagery. The Service must not be used to generate adult, pornographic, sexually explicit, NSFW, nude, or sexually suggestive material, content depicting or sexualizing minors, or any content that is hateful, violent, or otherwise illegal.

All generation prompts are screened by automated content-moderation systems before any image is produced. Prompts that violate this policy are blocked and no content is generated. Repeated or deliberate attempts to produce prohibited content will result in immediate suspension or termination of your account, and may be reported to the relevant authorities where required by law.

Intellectual Property

The Caratory name, website, software, and design are owned by us and protected by law. These Terms do not grant you any rights to our brand or technology except the right to use the Service as intended.

Service Availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time.

Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Caratory shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve months before the claim.
